Our Approach to Copyright

We respect the intellectual property rights of others and expect the same of anyone who interacts with our websites. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act, 17 U.S.C. section 512. This site does not host content uploaded by the public; the content here is created by us or used with permission, including client stories and review screenshots shared with the permission of their authors.

How to Send an Infringement Notice

If you believe content on this site infringes a copyright you own or control, send a written notice to our copyright contact: Joel David Real Estate, Attn: Copyright Notice, 808 N Diamond Bar Blvd, Diamond Bar, CA 91765. Email: Team@JoelDavidRE.com with the subject line “DMCA Notice.” Phone: (626) 736-1817.

For your notice to be effective under the DMCA, it must include: (1) a physical or electronic signature of the copyright owner or a person authorized to act for them; (2) identification of the copyrighted work you claim is infringed; (3) identification of the material you claim is infringing and enough information for us to locate it, such as the page address; (4) your name, mailing address, telephone number, and email address; (5) a statement that you have a good faith belief the use is not authorized by the copyright owner, its agent, or the law; and (6) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act for them.

What We Do With a Valid Notice

When we receive a notice that meets the requirements above, we will review it promptly, remove or disable access to the identified material while we investigate, and notify the person who provided the material if applicable. If we determine the claim is valid, the material will stay down.

Counter Notices

If your material was removed because of a notice and you believe the removal was a mistake or the material was misidentified, you may send us a written counter notice that includes: your physical or electronic signature; identification of the removed material and where it appeared; a statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification; and your name, address, phone number, and a statement that you consent to the jurisdiction of the federal district court for your district, or for the Central District of California if you are outside the United States, and that you will accept service of process from the person who filed the original notice. If we receive a valid counter notice, we may restore the material in no less than 10 and no more than 14 business days, unless the original claimant tells us they have filed a court action.

Misrepresentation

Under 17 U.S.C. section 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorney fees. Please make sure your notice or counter notice is accurate before sending it.

Repeat Infringement

Where applicable, we will end our relationship with anyone who repeatedly infringes the copyrights of others.
